A DBA (“Doing Business As”) is sometimes called an assumed name, trade name, or fictitious name. It is the public name for your business. For example, if you own a restaurant called “Joe’s Cooking LLC,” you can still own and operate Joe’s Nutrition Center or Joe’s Juice Bar by setting them up as different DBAs. As long as the business is registered and all of your operating licenses are in good standing, you can use multiple DBAs for one legal business.

 

DBAs are a great way to experiment with a new product or brand without having to form a separate legal business.

 

DBA requirements are complex in the United States. In most states, this means registering with the office of the Secretary of State or with the county where you formed your business. If you want to conduct business under a name that differs from your incorporated name, you must first file a DBA.

 

A DBA is not mandatory for sole proprietorships, general partnerships, or LLCs. They can use only the owner’s name in business dealings. When you open a bank account, you need a DBA. Without a DBA, you will have to open the account in your name.

If you are doing business under a name other than your LLC or corporation name, you must register your DBA.

Some states require that any business registering for a DBA run a public notice in a local newspaper. Depending on your location, the details will vary. We can find a suitable publication in your area most of the time.

Most DBA names last for 10 years. You’ll get your official notice and be given renewal options in plenty of time to renew before or after your DBA expires. However, your DBA won’t expire in a few states like Indiana, Iowa, and New York.

Having a DBA (Doing Business As) name registered to your business will prevent other organizations from using that name in your local area. If you have long-term branding or marketing plans, this is ideal for you and your business.
